Creditors Rights

If Someone Owes You Money, We'll Help Protect Your Rights

If you have loaned money to an individual or business entity which has filed bankruptcy, what rights do you have as a creditor. Many debtors quickly run for cover behind bankruptcy protection, but that doesn't mean they can simply walk away from what they owe you.

An experienced bankruptcy lawyer can explain your creditor rights and help you decide if you have a collections case worth pursuing. At the offices of CBG Law Group, PLLC, we protect creditors' rights in bankruptcy. Attorney Darrel Carter has been working with creditors in bankruptcy courts throughout Washington for more than 20 years. We can help you recover the money owed to you.

You Acted in Good Faith When You Loaned the Money. Did the Borrower?

The bankruptcy system requires all parties to act in good faith, as both debtors and creditors have rights. If you are afraid your debtor might never pay their debt in full, you may want to take legal action so that you can collect as much of the debt as possible. We help creditors protect their rights in the following areas:

  • Bankruptcy fraud: Has someone who owes you money committed fraud? If so, they will not be able to discharge their debts, which means you can collect.
  • Proofs of claim: Once a debtor has gone into bankruptcy, you can acquire a proof claim, which will detail the amount of money you are owed. This way, you can seek to recover at least some of the money you are owed.
  • Preference actions: Is a trustee coming after you for a payment made by a debtor prior to their filing for bankruptcy? You may not have to give those payments back. Contact us to find out more.
